Welcome to Fail.AI (the "Website"), a platform dedicated to documenting and discussing the failures and unintended consequences of artificial intelligence. These Terms and Conditions ("Terms") govern your access to and use of the Website and its content, services, and features (collectively, the "Service"), operated by Fail.AI ("we," "us," or "our").

Fail.AI provides two main types of content:

  • Aggregated News Summaries: We identify, aggregate, and summarize publicly available news articles and reports related to AI failures. We make a reasonable effort to cite and link back to the original source of this information.

  • User-Generated Content ("User Stories"): We provide a platform for our readers ("Users") to submit and share their personal stories, experiences, and observations related to AI failures.

2. Important Disclaimers - Please Read Carefully

  • No Validation of User Stories: You acknowledge and agree that User Stories are submitted by third-party users and are not investigated, verified, or endorsed by Fail.AI. We do not guarantee the accuracy, completeness, truthfulness, or reliability of any User Story. The views expressed in User Stories belong solely to the author and do not represent the views of Fail.AI.

  • Content Provided "AS IS": All content on this Website is provided on an "as is" and "as available" basis. Your reliance on any information provided on the Service is solely at your own risk.

  • No Professional Advice: The content on Fail.AI is for informational and educational purposes only. It does not constitute technical, financial, legal, or any other type of professional advice. 3. User-Generated Content (User Stories)

If you submit a story, comment, image, or any other material to our Service ("User Content"), you agree to the following:

  • License Grant: You retain ownership of your User Content. However, by submitting it, you grant Fail.AI a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, publish, modify, adapt, create derivative works from, publicly display, and perform your User Content in any and all media or distribution methods now known or later developed.

  • Your Representations and Warranties: You represent and warrant that:

  • You are the sole author and owner of the User Content, or you have all necessary rights, licenses, and permissions to submit it and to grant us the rights described in these Terms.

  • Your User Content is true and accurate to the best of your knowledge and based on your personal experience.

  • Your User Content does not and will not infringe upon the intellectual property rights (including copyright, trademark), privacy rights, publicity rights, or other rights of any third party.

  • Your User Content is not defamatory, libelous, obscene, harassing, threatening, or otherwise unlawful.

  • No Obligation to Publish: We are under no obligation to publish or otherwise use any User Content you submit and may remove it at our sole discretion at any time and for any reason.

4. Reporting Inaccuracies and Takedown Policy

Fail.AI respects the truth and the rights of others.

  • Factual Inaccuracies: If you believe that a User Story contains a material factual inaccuracy, please contact us at hello@gofail.ai with the subject line "Inaccuracy Report." Please provide a link to the story in question and a detailed explanation of the alleged inaccuracy with any supporting evidence you may have. We will investigate the claim in good faith and, if we deem it appropriate, we will remove or amend the content at our sole discretion.

  • Copyright Infringement (DMCA Policy): If you are a copyright owner and believe your work has been copied in a way that constitutes copyright infringement, please follow our DMCA Notice and Takedown Procedure. Send a notice to our designated Copyright Agent at hello@gofail.ai with the subject line "DMCA Notice" containing all of the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.

  2. Identification of the copyrighted work claimed to have been infringed.

  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material.

  4. Your contact information, including your address, telephone number, and an email address.

  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FAIL.AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (C) ANY CONTENT OBTAINED FROM THE SERVICE, ESPECIALLY UNVERIFIED USER STORIES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

6. Indemnification

You agree to defend, indemnify, and hold harmless Fail.AI and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your submission of User Content that infringes on a third party's rights or is otherwise unlawful.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice of any significant changes. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
